We have a law in India which allows cops to arrest people without any proof for the same

In India, there is a law called IPC -498-A which says that a wife can get her husband and her in-laws arrested or even convicted without evidence. The sole statement and complaint of the wife shall primarily hold as evidence and police can arrest without any evidence against the accused.

Result of it was that many women started blackmailing their husbands and in-laws and many false cases of dowry were unearthed, some of them even managed to disprove them by phone and video recordings.

MY QUESTION IS:

What is your opinion about this baseless law?

My opinion is that it is perhaps the world's first law where a judgment or decision is given without evidence and I am strongly against this law. It is a blot and a disrespect to the legal system. 


Also, my opinion for advantages which it provides to women is that firstly, they don't have to struggle or take the trouble for collecting evidences for claiming their husbands or in-laws guilty ,if their story is true. Secondly, if their story is not true, then it provides them an easy platform to extort money or accept other demands made by them from their husbands or in-laws. 

In December 2013, Union Minister Farooq Abdullah said that he is afraid even to talk to girls or women and decides not keep any female employee even if she is ugly because the sole complaint of the women/girl shall land him in jail. He also said angrily that why don't the media personnel send all men to jail.

Expressing exasperation over rampant misuse of Section 498A, a bench of Justices C K Prasad and P C Ghose said if police arrested the accused, the magistrate should weigh the preliminary evidence against the Section 41 checklist before allowing further detention.

Many lawyers have also suggested that employers should not keep lady secretaries as they can misuse the laws and get any guy arrested by lodging a false complaint without giving any evidence for their accusations.

We can afford to avoid hiring women in organizations, but due to the fear of this law, we cannot afford to stop marrying.  This is not a feasible solution as this creates more problem for people and the society comparing with the solutions. What needs to be suggested is that proper investigations and verification should be done to find out that which families and girls are genuine who will not blackmail there future husbands and in laws.

There needs to be a solution to this because every 9 minutes one married man commits suicide.

Heist cases

A heist case is that criminal case which has been unsolved till date.

I am going to write about a heist case which happened in 1987 in Mumbai, i.e 29 years ago.

Conman who stole USD $1 lac in 1987 is still untraceable which is shameful & wasn't dis not fully investigated?
1.) A conman in my country (India) came to Mumbai on March, 1987 and entered an ad on newspaper asking for 50 dynamic candidates for a post of CBI govt officers (Central Bureau of investigation).
2.) After selecting 28 of them, he handed them fake government ID cards and asked them to accompany them to raid a jewellery shop, while stopping for a refreshment at a beach for cold drinks and snacks.
3.) After entering the jewellery shop he asked the owner to close down the CCTVs, disconnect phone lines and collected all the suspicious ornaments and cash amounting to about Rs. 35 lacs (USD $ 1,10,062 in those days and today the value would be USD 53,030) after flashing another fake search warrant.
4.) He asked the 28 people to guard the shop while he excused himself that he had to go for another raid.
5.) AFTER THAT HE DISAPPEARED...WITH THE CASH AND JEWELLERY.

When he did not return for 4 hours, police was called, they investigated and found out that:
1.) He had booked a room in Taj Hotel and said that he came from south Indian state of Kerala, Trivandrum.
2.) When Hotel authorities had refused to allow him to hold interviews, he rented an office nearby.
3.) After disappearing with the booty from the shop, he had booked a Taxi from hotel and got down near Vile Parle in Mumbai, and after that got into Auto (another rented transport vehicle but of low cost), FROM WHERE HE FINALLY DISAPPEARED FOREVER.

Now, perfect crime rarely or doesn't exist. This person is still untraceable since 1987, i.e. since 26 years. The police did search for him but by useless and indefinite methods, like informers and the address given in hotel which was likely to be fake.

1.) The police could have drawn his sketch, collected initial footage of the CCTV as he must have taken time to switch off the CCTV after entering.
2.) They could have even made out that he probably went to the Airport as the Mumbai International Airport is just about 2 Kms from Vile Parle where he was last seen. From Airport, lot of details could be availed and if he went abroad, then a lot more as going abroad requires passport with affixed photograph.
3.) They could have also asked people from all over Mumbai by inserting ad or whatever that they required photos clicked on beach that day when he paused there with his staff for refreshments.
